Examples of events that can qualify a client for the ERC based on a full or partial suspension:

  • Closure of the business

    • During the beginning of the pandemic stay at home orders closed most non-essential businesses

    • Business office space was shutdown to be sanitized after a COVID-19 outbreak and the work conducted in the office could not be conducted outside of the office in a comparable manner

  • Closure of part of the business

    • Indoor dinning of a restaurant was closed to the public

    • Capacity limits on indoor outdoor spaces of business limited Employer’s ability to provide goods or services

    • Business spaces were closed or had limited use to the public

    • Employer couldn’t bring clients into the business space due to government orders limiting the spread of COVID-19 which limited Employer’s ability to sell its services to customers

    • Event spaces were not available or delayed due to government order which Employer needed to conduct or market its business

    • Due to government orders Employer experienced challenges finding and/or retaining employees

    • Due to government orders Employer experienced a reduction in operations

  • Closure of 3rd parties that result in a reduction in the Employer’s ability to provide goods or services

    • Supply Chain issues such as delays, increase in costs, and limited availability of goods

    • Court closure causing delays to law firms in scheduling hearings and trials

    • Closure of suppliers causing employer to not be able to provide goods or services as quickly as pre pandemic times or not provide goods or services at all

    • Government orders modifying operations at ports resulted in delays in importing goods Employer needs for its business

    • Government orders modifying operations at ports resulted in supplier experiencing delays in importing goods which created delays in how fast Employer could received goods necessary to obtain its goods.

    • Closure to gov’t offices that delay employer’s ability to get permits required to operate business activities

    • Employer couldn’t conduct in person marketing services such as door to door sales
